Defense Minister Avigdor Lieberman called on the family of Azariah Elora not to file a new appeal against the decision of the court, and to appeal to the chief of staff Gadi Eizenkot with clemency.
«I have no doubt that he will take into account the difficult circumstances of this case, the suffering that had to endure the family and the fact that we are talking about a great soldier who for fifteen years was under arrest at their base,» said Lieberman.
Sunday, July 30, the court of appeal in the «Kyrie» upheld the verdict and sentence in the case of Uzziah. The decision was taken by a majority of three judges. Two judges demanded to increase the punishment of Uzziah.
On 4 January, the military court acknowledged Azariah guilty of manslaughter of a terrorist, and in conduct unworthy of a soldier. February 21, a military court in the «Kyrie» sentenced him to 18 months in prison and 12 months probation. The court also ruled to Azariah demoted in rank. The court granted the request of the defence to delay the start of the sentence before the verdict on appeal.
From the day of the incident prior to demobilization from the IDF ALOR Azariah was at its military base in the open arrest. After demobilization on 20 July he was transferred under house arrest.
