Thursday, February 25, the constitutional court declared the norms of the criminal procedure code, according to which women in a Russian court were deprived of the right to trial by jury, reports RIA Novosti.
According to the Russian Criminal code, a woman could not be sentenced to death or to life imprisonment. Therefore, the criminal cases against women were considered only in the district courts, and in courts at the district level does not have trial by jury, women in Russia in fact were deprived of the right to trial by jury.
The constitutional court recognized that depriving women of the right to jury trial «does not meet the principle of legal equality leads to discrimination and limits their right to judicial protection».
As informs «Interfax», the President of the constitutional court Valery Zorkin said in an interview with reporters that the court’s decision does not cover the case of Nadezhda Savchenko, as it is a matter already appointed for consideration with the participation of a panel of judges, and the decision of the COP should not have retroactive effect.
