Chief district psychiatrist of Jerusalem has issued a report stating that Yosef Haim Ben-David, accused of the murder of Arab teenager Muhammad Abu Dhara, sane and could be held accountable for their actions. According to information published by the Second channel ITV, experts have described Ben-David as mentally healthy, deceitful and manipulative person. The doctors will allow the court to give the defendant a guilty verdict.
Earlier, according to the results at the insistence of the prosecution psychiatric examination Ben-David was declared sane. However, the day before the verdict, attorney Ben David presented the results of an independent examination, according to which the latter is insane and cannot be held responsible for their actions.
November 30 last year, the court ruled that Ben-David had committed the punishable action. However, based on the opinion of psychiatrists, the judge decided that the accused may not be currently found guilty and postponed the announcement of the verdict pending further examination.
Two juvenile accomplice Ben-David were found guilty of murder, kidnapping and grievous bodily harm. 17-year-old boy, who according to the court, was directly involved in the murder of a teenager, sentenced to life imprisonment and in addition to three years in prison. 16-year-old convict sentenced to 21 years in prison. In addition, the criminals will pay the family of the victim for compensation in the amount of 60 thousand shekels. The names of prisoners remains prohibited.
16-year-old Muhammad Abu Khdeir was killed on 2 July 2014. His murder was committed in retaliation for the killing by terrorists of Hamas by the Israelis Naftali Frenkel, Gilad Shaera and he ifrah. Police later detained three suspects in murder of Arab teen. The trial began in September 2014.
According to the indictment, wanting to avenge the murder of three Jewish teenagers, criminals abducted Muhammad Abu Dhara. They took him to the Jerusalem forest, on the way was beaten unconscious and then doused with a combustible mixture and set fire. After that, the attackers left the scene.
When the police found the dead body of an Arab teenager, established two research groups: one was checking the version of the murder on criminal grounds, the second on national. Despite the fact that the recordings of the cameras located along the route of the kidnappers, wasn’t able to see the number and color of the car, as well as the faces of the kidnappers, investigators police and the Israel security Agency was able to identify the suspect vehicle and find it in one of the suburbs of Jerusalem. All the police detained six suspects, but found that three of them – two adults and one juvenile – were not involved in the crime, and only learned about it after the fact.
Muhammad Abu Khdeir was officially recognized as a victim of a terrorist attack within a few days after a suspect in his murder indictment. This decision was made by a special Commission of the Ministry of defence.
It is noted that a day before killing Abu Dhara the accused tried to abduct seven year old Arab child in a quarter of Beit Hanina (not the North-East of Jerusalem), but this attempt was unsuccessful.
